    These Terms of Service ("Terms") govern your access to and use of Etzium, operated by PT DVNCI ("Etzium," "we," "our," or "us"). By creating an account or using our website, applications, or related services (the "Services"), you agree to be bound by these Terms. If you do not agree, you must not use our Services.

    Eligibility and Accounts

    You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use Etzium. By creating an account, you represent that the information you provide is accurate, complete, and kept up to date. You are responsible for maintaining the security of your account credentials and for all activities conducted under your account. Etzium is not liable for losses or damages caused by unauthorized use of your account.

    Description of Services

    Etzium provides AI-powered tools to assist sellers in generating product listings, including titles, tags, and descriptions, for online marketplaces such as Etsy. Our Services include a free plan with limited usage, as well as subscription plans offering higher generation limits.

    The listings generated by Etzium are created using artificial intelligence models. While we strive to provide high-quality outputs, the generated content may contain inaccuracies, may not comply with marketplace policies, or may require editing before use. You are solely responsible for reviewing, modifying, and deciding whether to use any generated output.

    Subscriptions and Payments

    Access to premium features requires a paid subscription. Subscription fees, limits, and available plans are described on our website and may change from time to time. Payments are securely processed by Paddle, our third-party payment provider. We do not store or process payment card information.

    Subscriptions automatically renew at the end of each billing cycle unless you cancel prior to renewal. If you cancel, you will retain access until the end of your current billing period. Refunds are only provided where required by applicable law.

    We reserve the right to change subscription prices, features, or limits, and will provide reasonable notice of such changes.

    Refund Policy

    All subscription payments are final and non-refundable, except where refunds are required by applicable law. Paddle, our payment provider and Merchant of Record, may process refunds at its discretion under its buyer protection policies or in order to comply with legal requirements. Any such refunds will be deducted from amounts otherwise payable to us.

    User Content and Intellectual Property

    You retain ownership of any images, text, or other materials you upload to Etzium. By using the Services, you grant us a limited, non-exclusive license to process this content solely for the purpose of providing and improving the Services.

    We make no claims to ownership of the AI-generated outputs you receive. Subject to these Terms, you are free to use the outputs for your business purposes. However, we make no guarantee that the outputs will be original, non-infringing, or compliant with Etsy or other third-party requirements.

    All intellectual property rights in the Services, including software, designs, trademarks, and branding, are owned by PT DVNCI or our licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Services except as expressly permitted by law.

    Prohibited Uses

    You may not use the Services for any unlawful, harmful, or abusive purposes. Prohibited conduct includes:

    • Using the Services to create content that violates intellectual property rights, privacy rights, or applicable laws.
    • Uploading malicious code, attempting to disrupt the Services, or interfering with security features.
    • Reselling or redistributing access to Etzium without our prior written consent.
    • Using automated means to excessively access or abuse the Services beyond normal use.

    We reserve the right to suspend or terminate accounts engaging in prohibited activity.

    Disclaimers

    The Services are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose, or non-infringement.

    We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that generated outputs will meet your expectations or lead to business results. You acknowledge that reliance on AI-generated content carries inherent risks, and you are solely responsible for verifying the suitability of outputs for your intended use.

    Limitation of Liability

    To the maximum extent permitted by law, Etzium and PT DVNCI shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to lost profits, lost business opportunities, or reputational harm, arising out of or in connection with your use of the Services.

    Our total liability for any claim arising out of or related to these Terms shall not exceed the amount you paid to us for the Services in the twelve months preceding the claim. Some jurisdictions may not allow certain limitations of liability, in which case such limitations may not apply to you.

    Indemnification

    You agree to indemnify and hold harmless PT DVNCI, its affiliates, officers, employees, and agents, from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

    Termination

    You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, misuse the Services, or if continued access would create legal or security risks. Upon termination, your rights to access the Services will cease, but provisions relating to intellectual property, disclaimers, limitation of liability, and indemnification will survive termination.

    Governing Law

    These Terms are governed by and construed in accordance with the laws of Indonesia, without regard to conflict of laws principles. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Indonesia, unless otherwise required by applicable law.

    Changes to Terms

    We may update these Terms from time to time to reflect changes in our Services, practices, or legal requirements. When material changes occur, we will notify you by posting an updated version on our website or by contacting you directly when appropriate. Continued use of the Services after such changes constitutes acceptance of the revised Terms.
